Chene Gear Co., LLC (“Chêne Gear”) is committed to protecting your online privacy because without you and your endless support, we wouldn’t be able to bring you gear that is Built Better. And because we know that privacy is very important, information Chêne Gear collects through its www.chenegearshop.us website (“Site”) will only be used in the manner and for the purposes described in this Chêne Gear Privacy Policy Statement (“Privacy Policy”).

 

1. INFORMATION CHÊNE GEAR COLLECTS

(a) When you purchase gear, apparel and/or other Chêne Gear products from our Site, as part of the buying and selling process, Chêne Gear collects personal information that you provide us, such as your name, address and email address.

(b) When you browse our Site, Chêne Gear also automatically receives your computer’s internet protocol (IP) address in order to provide us with information that helps Chêne Gear learn about your browser and operating system.

(c) Email marketing (if applicable): With your permission, Chêne Gear may send you emails about our Site, new products and other updates.

(d) If you choose to interact with Chêne Gear via a social media platform or other third party service, Chêne Gear will collect the information you have provided us through that platform.

(e) If you provide us feedback or contact us via email, Chêne Gear will collect your name and email address, as well as other content included in your email to Chêne Gear, in order for us to respond.

(f) Chêne Gear may receive personal or anonymous data about you from certain third parties, such as demographic information from Facebook tools. Chêne Gear may add this information we have already collected from you via our Site in order to improve the services we provide.

 

2. CONSENT

(a) Chêne Gear obtains your consent when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

(b) If Chêne Gear asks for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

(c) You have the right to ask for access to any personal information that Chêne Gear holds about you in our records.

    3. DISCLOSURE

    (a) Chêne Gear may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

    (b) Chêne Gear may disclose certain information in order to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of its assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Chêne Gear about our Site users is among the assets transferred.

     

    4. SHOPIFY

    (a) Our Site is hosted on Shopify, Inc. Shopify provides us with the online e-commerce platform that allows Chêne Gear to sell products and services to you.

    (b) Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall.

    (c) Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

    (d) All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

    (e) PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

      5. THIRD-PARTY SERVICES

      (a) Chêne Gear may share your personal information with third parties, including advertising networks, data analytics providers, social networks, our corporate affiliates and service providers for a business or commercial purpose.

      (b) In general, the third-party providers used by Chêne Gear will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to Chêne Gear.

      (c) However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information Chêne Gear is required to provide to them for your purchase-related transactions.

      (d) For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

      (e) In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or Chêne Gear.       (f) As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

      (g) Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms of Service.

      (h) Third-Party Links: When you click links on our Site, they may direct you away from our Site. We are not responsible for the privacy practices of other websites and encourage you to read their privacy statements.

       

      6. SECURITY

      (a) To protect your personal information, Chêne Gear takes reasonable precautions and follows industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

      (b) If you provide Chêne Gear with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

        Similar to other ecommerce and Shopify platforms, Chêne Gear's Site logs IP addresses and uses cookies and similar technologies that allow Chêne Gear to recognize you and to customize your experience, and provide Chêne Gear with information about the way our users access our Site.

        In the last 12 months, Chêne Gear may have shared with third parties, for a business or commercial purpose, the types of personal information set-forth in Section 1 and Section 7 above.

         

        13. SALE OF PERSONAL INFORMATION

        In the last 12 months, Chêne Gear has not sold any personal information. The CCPA defines a “sale” of personal information as the disclosure, sharing, or making available of a consumer’s personal information by a business to another business or third party for monetary or other valuable consideration. Although Chêne Gear is not in the business of selling your personal information, you may opt-out of the sale of your personal information by contacting Chêne Gear’s compliance officer below.

         

        14. CALIFORNIA CONSUMER RIGHTS

        California consumers that are California residents have the right to request access to the specific pieces of personal information Chêne Gear has collected about them in the last 12 months. You may make this request up to two times in a 12-month period. You may also request additional details about our personal information collection practices as set forth above. If you are a California consumer and a California resident, you also have the right to request deletion of your personal information (subject to certain exceptions) as set forth in Section 8 below and to receive equal service and price and not be discriminated against even if you exercise any of your CCPA rights.

         

        15. EXERCISING ACCESS, DATA PORTABILITY, AND DELETION RIGHTS

        You have the right to request that Chêne Gear delete any of your personal information that we collected from you and retain, subject to certain exceptions. Your request must include sufficient information that allows Chêne Gear to reasonably verify you are the person about whom Chêne Gear collected personal information, which may include your email address, name and account id (which is required only if you already have an account with Chêne Gear). Once Chêne Gear receives and confirms your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records.

         

        16. OTHER CALIFORNIA PRIVACY RIGHTS

        In addition to the CCPA, the California Civil Code (Ca. Civ. Code § 1798.83) permits California residents with whom Chêne Gear has an established business relationship to request that we provide you with a list of certain categories of personal information that we have disclosed to third parties for their direct marketing purposes during the last 12 months.
